Laws on End of Life Care and Living Wills with Dhvani Mehta

    By Shonottra Kumar | 18 March, 2021

Key decisions around end of life care often relate to the withholding and withdrawing of life sustaining treatment i.e stopping medical care or deciding not to start medical care for patients for whom further treatment may not help. For instance, a decision not to revive someone who suffered a cardiac arrest or a decision to take someone off a ventilator.

End of life decisions are often taken for terminally ill persons or for those in a coma or a persistent vegetative state. Dhvani Mehta, co-founder and Vidhi Centre for Legal Policy explains the law dealing with end of life care and the making of living wills in India.

Patient Rights in India with Anjela Taneja

    By Shonottra Kumar | 25 March, 2021

India does not have a specific or singular law addressing rights of patients but various existing Indian laws grant rights to individuals who approach healthcare establishments. These laws ensure that people can access medical care and receive dignified treatment. To make these rights coherent and easy to understand for the public, the Ministry of Health and Family Welfare and the National Human Rights Commission have compiled the Charter of Patient Rights. While it is yet to be formally enacted, the rights enumerated are already available to people under existing laws.

We spoke to Anjela Taneja of Oxfam India, to understand some of these rights better, how they operate in this ongoing pandemic and what are recourses available to the people when these rights are violated. Have any questions or thoughts about the video? Let us know in the comments below.

Love Laws and the Rights of LGBT+ Persons

    By mayank | 23 February, 2021

Navtej Singh Johar vs. Union of India was one of the most widely discussed cases since 2018, and rightly so, for it overturned an archaic provision from India’s penal law and granted the LGBT community equal rights and protection under law. But what are the implications of this judgement? What are the rights that members of the LGBT+ community received after the judgment? Can same-sex couples now marry under Indian law? What is the legal recourse available to a person when they face discrimination and violence on the basis of their gender identity or sexual orientation? Watch this video to find out.
